Background: Virginia COVID-19 Final Permanent Standard

The Virginia Safety and Health Codes Board adopted §16VAC25-220, Final Permanent Standard for Infectious Disease Prevention of the SARS-CoV-2 Virus That Causes COVID-19 on Jan. 13, 2021. It is in effect as of Jan. 27, 2021.

Important deadlines:

  • March 26 – Infectious disease preparedness and response plans must be completed
  • March 26 – Training Requirements go into effect

The VMA released a COVID-19 Model Action Plan to guide employers on how to respond to the COVID-19 crisis. This focuses on Employee Communication, Operations Risk Assessment and Mitigation Efforts, Media, and Local Leaders/First Responders.

VMA’s Safety Regulation Subcommittee provides its members with the means to improve safety performance through programs, training, service and “best practices” professional development as well as government affairs services pertaining to the Virginia Department of Labor and Industry.

Our Legal Counsel, Courtney Malvauex, Principal, Jackson Lewis PC, is available for legal services related to OSHA.

Mr. Malveaux advises and represents employers in employment law matters, including retaliation claims, employment discrimination, unemployment benefits and wage claims. He also represents business associations in state and federal legislative and regulatory matters, and he has testified before Congressional and state legislative committees on workplace safety  and health matters.

Mr. Malveaux represents industry on the Virginia Safety and Health Codes Board, and pulled together a broad coalition of business and safety associations to pass laws in four states to make voluntary compliance a permanent part of a state Occupational Safety and Health Act.

Before joining Jackson Lewis, Mr. Malveaux enforced occupational safety and health law and other state and federal labor laws as Virginia’s Labor Commissioner while also serving as President of the National Association of Government Labor Officials. Full bio >>>
